Conditions of Sale

1. Nature of the project and website
MARGALLO Fine Art Photography is Federico Margallo's personal artistic project.
The website federicomargallo.it presents the artist's photographic works and allows interested parties to request information about their availability and possible purchase.
The website is not an online shop and does not enable automatic orders or payments. The artworks are offered directly by Federico Margallo as a private individual, through occasional sales of his own creations and, at present, outside an organised business or professional activity.
Should the nature or organisation of the activity change, these conditions will be updated before new sales are accepted.
2. Purchase enquiries
The information on the website, including images, descriptions, formats and price indications, is provided for information only and does not constitute a binding offer.
Interested parties may submit an enquiry through the contact form or by emailing info@federicomargallo.it, specifying the artwork and preferred format.
An enquiry does not create an obligation to purchase and does not require Federico Margallo to accept the sale.
Before confirmation, the following will be communicated in writing:
- title and characteristics of the artwork
- selected format and medium
- edition number or availability
- any frame or finish
- price of the artwork
- insured-shipping cost
- delivery destination
- estimated production and shipping times
- total amount payable.
3. Conclusion of the sale
A sale is accepted only after:
- Federico Margallo has confirmed the characteristics and total price in writing
- the purchaser has accepted these conditions
- payment has been received by bank transfer.
Until then, either party may end the discussion without charge, unless otherwise agreed in writing.
If payment is not received by the deadline stated in the confirmation, availability of the artwork or edition number cannot be guaranteed.
Federico Margallo may decline an enquiry if the artwork is no longer available, the edition is sold out, production or shipment is not technically possible, or the information provided contains an obvious error. Any amount already received will then be refunded in full.
4. Prices and payment
Prices are stated in euros. The final price, including any finishing and shipping costs, is always communicated before payment.
The sale is made by a private individual as an occasional activity; VAT is therefore not charged, unless the seller's tax status changes in the future.
Payment is accepted exclusively by bank transfer using the details provided privately in the sale confirmation. Any fees charged by the purchaser's bank remain the purchaser's responsibility.
Documentation required under the applicable rules will be issued for each sale.
5. Production
Artworks are produced on request in the format, medium and specifications agreed with the purchaser. Production starts after payment has been received.
Stated production times are good-faith estimates and may depend on the availability of the printing laboratory, materials, finishes and transport services. The purchaser will be promptly informed of any significant delay.
If a delay makes it impossible to complete the artwork within a reasonable time, the purchaser may agree a new deadline or cancel the sale and receive a refund of the amounts paid.
6. Characteristics of the artworks
Images on the website represent the artworks as faithfully as possible. Their appearance may nevertheless vary according to the screen, brightness, calibration and device used.
Minor differences in colour or rendering, where consistent with normal fine-art printing processes and the selected materials, do not constitute a defect.
Before production, the purchaser receives a description of the artwork's essential characteristics. Any requested changes must be agreed in writing before production begins.
7. Limited editions and certificate of authenticity
Where indicated, an artwork forms part of a limited edition. Its edition number is recorded and will not be assigned again to the same artwork in the same format and edition.
The artwork is supplied with its certificate of authenticity, containing at least the identifying details of the artwork and edition.
Loss of or damage to the certificate must be reported to Federico Margallo. Any replacement declaration will be considered after checking the information in the edition register.
8. Shipping
Shipping is available to European destinations that can be served under appropriate security conditions. Feasibility and delivery cost are checked before the sale is confirmed.
All artworks are shipped using a tracked and insured service. Packaging is selected according to format, medium and destination.
For European destinations outside the European Union, customs duties, import taxes or clearance charges may apply. Unless expressly included in the written confirmation, these costs are the purchaser's responsibility.
The purchaser must provide a complete and accurate address and cooperate with the carrier. Additional costs caused by an incorrect address, failure to cooperate or storage not attributable to the seller may be charged to the purchaser.
9. Damage in transit
On delivery, the purchaser is invited to inspect the packaging. If it shows obvious impacts, openings or deformation, the parcel should, where possible, be accepted subject to a specific written reservation describing the damage on the carrier's document.
Damage to the artwork should be reported promptly to info@federicomargallo.it, preferably within 48 hours of delivery, together with:
- photographs of the external packaging
- photographs of the internal protective materials
- photographs of the damaged artwork
- a photograph of the shipping label
- a short description of what happened.
The 48-hour period is intended to facilitate the insurance claim and does not restrict any mandatory rights available under applicable law.
The purchaser must retain the artwork and all packaging until the carrier and insurer have completed their checks. Where damage is confirmed, Federico Margallo will agree either a replacement, where possible, or a refund of the amounts paid.
Where possible, a replacement copy will retain the same edition number. The damaged copy must be returned or permanently rendered unusable in accordance with the instructions provided, in order to prevent duplication of the edition.
10. Cancellations, changes of mind and returns
Before production begins, the purchaser may request cancellation. Amounts paid will be refunded after deduction of any documented, non-recoverable costs already incurred, provided those costs were disclosed in advance or were reasonably necessary.
Once production has begun, cancellations or returns based solely on a change of mind are not normally accepted because each copy is made specifically to the specifications confirmed by the purchaser.
The purchaser may always report an artwork that is:
- damaged in transit
- materially defective
- different in artwork, format, medium or essential characteristics from what was agreed.
Depending on the nature of the issue, an appropriate replacement, reprint, price reduction or refund will be considered. Nothing in these conditions excludes any mandatory rights that applicable law may grant to the purchaser.
11. Purchaser's responsibilities
The purchaser is responsible for the accuracy of the information and specifications confirmed before production, and for the suitability of the place where the artwork will be displayed.
Artworks must be handled, displayed and stored appropriately, avoiding excessive humidity, direct sunlight, heat sources, impact and unsuitable cleaning products. Damage caused by improper storage, installation or handling after delivery is not attributable to the seller.
12. Copyright
Purchase transfers ownership of the physical copy only.
Copyright and all rights of reproduction, publication, modification, distribution and exploitation of the image remain with Federico Margallo unless otherwise agreed in writing.
The purchaser may photograph the artwork for personal use and display or resell it as a physical object, but may not reproduce it, use it commercially, create copies or authorise its reproduction without the artist's written consent.
13. Personal data
Personal data are processed solely to manage enquiries, the sale, payment, documentation, the edition register and shipment, as described in the website's Privacy and Cookie Policy.
14. Applicable law and disputes
These conditions and completed sales are governed by Italian law, without prejudice to any mandatory rights granted to the purchaser by applicable law.
If a problem arises, the parties undertake to seek a direct and reasonable solution first by writing to info@federicomargallo.it.
If no agreement can be reached, territorial jurisdiction will be determined under the applicable rules, without imposing in advance any exclusive court that is not permitted by law.
15. Changes to these conditions
These conditions may be updated to reflect changes to the project, sales arrangements or applicable law. Each sale is governed by the version communicated to and accepted by the purchaser at the time of confirmation.
